Pay when you're sick

When an employee is unable to work due to illness, sick pay is paid.

Sick Pay is a legal requirement.

Sick pay is divided into two categories: statutory sick pay ('SSP'), which most employees are entitled to if they are unable to work, and contractual sick pay, which are earnings that an employee is entitled to receive if they are unable to work due to illness.

SSP, which pays £96.35 per week for up to 28 weeks, maybe available to employees.

SSP is reimbursed in the following ways:

  • 'Qualifying days' are days when an employee works normally.

  • deducting tax and national insurance in the same way as salaries, that is, on a regular payday

When employees are eligible for sick leave, they cannot be forced to take yearly leave.

When an employee is sick for more than four days in succession, they are entitled to SSP (including non-working days, such as weekends). From the 4th 'qualifying day,' the employer should begin paying SSP. The first three qualifying days are known as 'waiting days,' and the employee is not paid SSP during this time unless they had been sick and received SSP in the previous eight weeks.

When an employee returns to work or becomes ineligible for SSP, it typically ends.

Eligibility

When a worker meets the following criteria, he or she will be eligible for SSP:

  • a signed contract of employment (either written or verbal)

  • under their contract, I've completed somethings

  • have been sick for four or more days in a row (including non-working days) - this is referred to as a 'period of incapacity for work'

  • Earn a minimum of £120 per week (before taxes).

  • provide you with the necessary information

  • after 7 days off sick, provide you documentation of their ailment

Sick pay on the job

If your firm has a sick pay plan, you can offer more, but not less. Company sick pay plans, often known as "contractual" sick pay, are required to be included in an employee's employment contract.

When an employee is absent due to illness, their contract may provide that they will be paid their regular salary (in which case SSP is not required), or that they will be paid their regular salary less statutory sick pay. If the employee's contract does not provide for contractual sick pay, the employee will only be eligible for SSP.

Policy on sickness

According to some corporate illness policies, the employer has the option of paying SSP instead of contractual sick pay. If an employee is confused about how their employer handles sick leave, they should always examine their company's sick policy.

The Data Protection Act of 2018 should be familiar to employers (DPA). The Data Protection Act (DPA) is the fundamental piece of legislation that puts the General Data Protection Regulations into action (GDPR).

Employers must follow the DPA's standards for processing personal data, which include being transparent and informing employees about personal data and how it is used. Employers can comply with this requirement by posting a privacy notice when an employee begins work, outlining how data gathered to keep a record of absences and manage absence procedures is processed.

Employee health data is designated a "special category" of data, which means it must be processed according to specific criteria. If an employer has effective data protection and security policy in place, the DPA will allow them to process particular categories of data including criminal records in order to perform responsibilities or exercise rights under employment law.
